Dorset Council (Part of Footpath 50, Marshwood at Higher Sminhay Farm) Public Path Diversion Order 2019
On 11 September 2020 Dorset Council confirmed the above named order made under Section 119 of the Highways Act 1980 as unopposed and the Council has certified that work has been carried out to bring the site of the new highway mentioned in article 3 of the order into a fit condition for use by the public. The effect of the order as confirmed is to divert part of Footpath 50, Marshwood as shown on the order map as follows:-
From the existing path:
From its junction with Mutton Street at Higher Sminhay Farm at SY 38799911, east, passing between buildings to the field boundary at SY 38829912 and continuing east north east across the field to rejoin the unaffected part of Footpath 50, north east of Higher Sminhay Farm at SY 38879914. (No recorded width).
To the new path:
From its junction with Mutton Street, south south east of Higher Sminhay Farm at SY 38829907, east entering a field, then north east along the edge of the field to SY 38839908 and north to SY 38829909. Continue north east, across a track at SY 38849910, across a second field and track at SY 38869913, then north east across a third field to rejoin the unaffected part of Footpath 50, north east of Higher Sminhay Farm at SY 38879914. The width of this part of Footpath 50 is 2.5 metres between 38829907 and SY 38849910 and 2 metres between SY 38849910 and SY 38879914. Limitations: Pedestrian gates at 38829907 and SY 38849910 to BS5709:2018. A copy of the order as made and the order map are available on our website at

The order comes into force on 18 September 2020 but if any person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within six weeks from 17 September 2020, make an application to the High Court.
