A CHARD man accused of failing to comply with a breath test after being suspected of drink driving claimed he was not the driver of the car at the time.
Kurt Unsworth, 24, of Stringfellow Crescent, denied that on August 13 at Yeovil, when suspected of having driven a vehicle and having been required to provide a specimen of breath for analysis, he failed to do so.
The court heard Unsworth’s car was discovered after it had been driven into the wall of a property in Chard.
Unsworth attempted to run away from the scene but was detained by a witness.
When he was arrested he refused to comply with a police breath test and said that the car was being driven by another male at the time of the crash who had left the scene.
The matter was adjourned until November 29 when Unsworth must return to the court for a trial to take place. He was released on unconditional bail.
